Your Questions ? Answered
A member of IOMST had the following Question.
Question 1;
I have family members who help me while trading. If they get hurt am I covered for such claims?
Answer; Family members, helpers, volunteers are, under the law, deemed to be employees, therefore the policy holder should have Employers Liability Insurance.
Question 2;
I am a stall holder and when erecting my stall I ask a fellow trader for assistance and subsequently they hurt themselves. Is this covered under my public liability insurance?
Answer; No, not usually. As they have engaged with you to help in the course of your business, they then become a volunteer/helper and would therefore not be covered under a Public Liability policy. In this instance, any claim could only be made against an Employers Liability policy.
